Kompanija Gio Alien Inc bavi se pitanjima azila godinama unazad. Postali smo lider u USA po broju aplikanata azila za ljude sa podrucja Balkana (Srbija, Crna Gora, BiH, Severna Makedonija, Kosovo).

Nedavno 2023 smo se zalagali za prava da alien broj ponovo bude dodeljen u kratkom roku, jel 2022 se cekalo i 90-100 dana na to umesto do 20 dana kako je sada opet vrlo moguce nasom intervencijom i mozda jos nekih firmi koji se zalazu za prava. Takodje smo trazili da radna dozvola bude 3 godine, a ne 2 jel je velik zastoj ‘backlog’ u obradi, i nadamo se da su razmatrali taj predlog moje firme, i verovatno drugih jel je 3 meseca posle toga, znaci od skoro podignuta radna na trajanje od 5 godina. Sad lepe vesti znaci radna prva, pa posle obnova vazi 5 godina)

Takodje, ukazana mi je cast nedavno, Oktobar 2022 da saradjujem sa razvojnim timom digitalalizacije USCIS iz Washington DC po pitanju novih Alatki (tools) koje ce skoro biti uvedene i imigranti ce moci da koriste (slicno postojecem na google: Uscis case status – samo novije), gde sam imao priliku da isprobam i dam svoj komentar na novi ‘app’ sto je u pripremi. Akcentovao sam znacaj lakog kontakta sa Imigracijom kao najvaznija stvar koju imigrant zeli da ima. Na dodir dugmeta da posalje Upit (Inquiry) svojim recima o vremenu cekanja odnosno u slucaju kasnjenja .

Ziveti legalno u USA, znaci imati aktivan Alien broj. Alien broj je maticni broj gradjanina poput naseg JMBG pri rodjenju broja sto drzava dodeljuje. U Americi postoje samo tri legalna statusa : VISITOR, ALIEN i CITIZEN.

VISITORi su svu ljudi na vizama, sportisti, studenti, pa i investitori sa mnogo novca koji su dosli u zemlju. Kad udjete u proces dokumentovanja postajete ALIEN ( gde su ALIENi svi dokumentovani ljudi registrovani kod drzave. Alien su ljudi i koji nemaju zelenu i koji je imaju, ima razlike dole objasnjena u tekstu kasnije) i CITIZENi kao konacan status drzavljanina USA.

Znaci vas cilj je da dodjete do aktivnog Alien broja, koji ce znaciti da se se dokumentovali kod drzave da ste legalno u USA. Socijalni ili SSN je poreski broj, i nedaje legalnost vec samo sluzi oko legitimacije pri zaposlenju i za oporezivanje ljudi sto zive u Americi. Znaci ljudi koji imaju SSN a nemaju Alien broj nisu dokumentovani jos uvek.

Upravo smo dodali rubriku “Intervju i Sud” zbog ucestalosti pitanja o ovoj temi trenutno i detaljima poput kako da se spremite za intervju, dal vam treba advokat i zasto mozda bas i ne treba odma vec tek na Sudu. I najvazniju stvar koliko traje sud i koliko je on opasan ustvari koliko nije opasan i normalna je procedura do dobijanja papira. Takodje poceli smo saradnju sa pravnom kancelarijom koja je ovlascena za zastupanje na sudu, pa mozemo neke od usluga za klijente kojima je cvrst azil a prebaceni su na sud, da naprimer ‘ubrzamo’ sud preskakanjem master hearinga (upoznavanja sa sudijom) i trazenjem zakazivanja odma Indivudulanog hearinga (gde se ustvari cita vas azil) – i time se nadjete u prilici da dobijete zelenu kartu (trajni status) vec posle samo tog jednog saslusanja (jednog Individualnog hearinga) Molimo vas da procitate rubriku i pitajte me slobono o dobijanju zelene na sudu, jel sad ima pozitivnih promena koje sam ovde samo naveo a mogu dodatno na zahtev vas objasniti.

* *    PAZNJA : Sve veci broj imigranata mesa legalnost sa vadjenjem vozacke ili licne karte (ID-a) u USA. Niste legalni ako nemate Alien broj aktivan, znaci vadjenje vazacke u Seattle, WA gde mnogi nasi odlaze pod ‘instrukcijama’ prijatelja je pogresno i zabluda i moze da vam donese problem kasnije a sad cu objasniti kako. Ako izvadite ID ili vozacku a nezivite tamo i neko od komsija prijavi ili postar koji poznaje stanare jel radi godinama. Moze da vam se desi da unesu u kompjuter ‘fraudulent address” (krivotvorena adresa) – sto vam moze pratiti ceo vas zivot u USA bili da radite azil ili se ozenite kasnije – kad imigracija da zeleno svetlo za zelenu kartu FBI kome se prosledjuje provera imigranta moze da stopira i odlozi urucenje iste a da niko nezna zasto. Ni vi ni vas advokat recimo. A jedan od razloga moze biti krivotvorenost adrese. Tako da pazite. Imati licnu ili vozacku bez Alien broja nije legalnost. Imigracija kod kontrole bi vam makazama presekla na dva dela istu  i mozda vas privela cak. Tacno je da policiji ovo jeste dokaz da smete da vozite ali ja vam objasnjavam da znate da je to samo ‘privid legalnosti’ da znate da vadjenjem ovakvog dokumenta niste legalni. Dalje ako ste u proslisti i izvadili ovakav dokument i sada dobili radnu – odma menjajte sve na stvarnu adresu gde zivite jel upravo smo imali slucaj da sud, posle intervjua koji dolazi je recimo poslao stranci poziv na Seatlle, WA(jel Sud vidi da imigrant ima aktivnu licnu iz Seattla) iako stranka zivi u Chicago, IL time je stranka propustila sud i nasla se automatski u proglasenoj deportaciji. Pazite jedna greska tipa koriscenje starog ID-a ili Vozacke moze da vam napravi problem.

Za one koje su vec u procesu:

Proces azila traje kao sto znate ili 120 dana ako odma dobijete zelenu na intervju, ili 8 godina  ( vreme cekanja za intervju ako vas ne izvuku po novoj odluci odmah za 4 meseca). Znaci stvar je srece, i veci broj aplikanata ode na cekanje o 8 godina nego sto ima odma priliku da dobije zelenu za 4 meseca. Nazalost je tako. Ali opet mnogima i to koristi jel postajete legalni, i treba da zivite legalni u USA a ne da se krijete kad putujete izmedju drzava unutar Amerike, ili da nesmete kamionom da prodjete pored granica Canade ili Mexica gde ima check pointa (kontrole legalnosti osoba koje prolaze)

Ako ste usli u proces, vi imate “alien broj” to je najvazniji boravisni broj u USA, dobija se ulaskom u brak ili apliciranjem za azil. To vec znaci na neki nacin da imate papire ( trenuntno ste alien non-resident a dobijanjem zelene kasnije postajete alien-resident). Kljucna rec je da ste vec “Alien” a zelena kad dodje je samo veci stepen papira koje vec imate i put ka cilju a to je dobijanje americkog drzavljanstva. Vi sa alien brojem imate skoro ista prava (radna recimo) kao da imate zelenu sem sto vam je malo vise ograniceno putovanje van Amerike( morate da trazite dozvolu advance parole svaki put kad hocete da idete/putujete)

• Proveravanje dokle je stigao vas slucaj ne postoji – takodje unosenje vaseg receipt number-a vam nece doneti odgovor cak moze da se desi da sistem ne prepoznaje, sto ne znaci da niste u procesu vec jednostavno ta usluga Uscis-a nije u funkciji.

• putnicki document mozete da trazite dok cekate i otprilike jednom godisnje moze biti odobren na period uglavnom  od 4-8 nedelja sa retkim izuzecima vise. Informacija da nije sigurno ici sa putnickim dokumentom (advance parole) van granica nije tacna. Tacno je da pise da se ne garantuje ulazak ali se to odnosi na ljude koji u medjuvremenu slucajno ili namerno izazovu krivicno delo neko I recimo nadju se na poternici, u tom slucaju se drzava Amerika ogradjuje da takve slucajeve, tj. Lica ima pravo da ne pusti u zemlju. Za sve ostale ulazak je siguran. Ceka se do sat vremena u posebnoj sobi (secondary inspection) da provere da li ste vi stvarno ta osoba koja ima advance parole. Putnicki mozete sami da uradite jer je sve objasnjeno na sajtu. (detaljnije pod ‘putnicki dokument’).Drzava naplacuje 575.oo dolara obradu zahteva za putni.

• Radnu dozvolu trazite 151 dan od podnosenja ili je obnavljate ako istice(druga radna dozvola). Prva je besplatna dok se druga placa drzavi u iznosu od 410$ . U oba slucaja vise informacija imate na ovom saitu rubrika “radna dozvola”.

• Promena adrese, ako se preselite je lako izvodlijiva I traje 2 minuta. Radite je sami online tako sto na googlu kucate : ar-11 online. Popunite pazljivo sve. Case form je I589, Receipt number polje ostavite prazno ( system ne prepoznaje) Zip je zip gde ste ziveli na predhodnoj adresi pre ove u koju menjate. Jos jedno pitanje koje glasi in a US as: odgovor za vas je “other” pa u novo polje koje ce se onda pojaviti upisete: asylum applicant

• Vadjenje ID ili Driving licence – po zakonu je moguce al nazalost postoji nesklad u komunikaciji izmedju Imigracije I DMVa sto izdaju ove dokumente. Morate ici licno i najcesce traziti supervizora i objasniti da imate prava na ID uz pokazivanje papira da ste u procesu azila kao i papira da ste dali otiske i dobili crveni pecat. Cest je slucaj da ne cete naci ni supervizora koji dovoljno poznaje zakon i morati da odete do drugog DMVa i opet trazite isto. Mnogi aplikanti su dobili tj gotovo svi al su se namucili nazalost. Za Vozacku dozvolu ako ste na turistickoj vizi bili a u procesu azila sada, morate ici cak do Social Service ustanove da dobijete potvrdu da trenutno niste “eligible for social security number”

• Moj savet je ako osoba koja vam se javi ne moze da vam pomogne trazite da vas spoje sa supervizorom. Oni to zovu higher level. Ta osoba je bas imigracioni oficir i cesto ima pristup vecim informacijama na svom kompjuteru i moze vam vise pomoci od sluzbenika koji se prvobitno jave. Prvo naravno popricajte sa sluzbenicima jel cesto i oni mogu da vam pomognu. Budite uvek fini razgovori se snimaju i ako neznate engleski neka zove neko pored vas, tj u vasem prisustvu. On ce prevoditi. Ne savetujemo lazno predstavljanje da osoba koja zove kaze da je ustvari vi. Nego vi budite pored i potvrdno odgovorite na pitanje dal se slazete da osoba pored vas vam prevodi.

• Cesto pitanje sklapanje braka : ako se ozenite a u azilu ste I hocete da sa svojom/svojim suprugom udjete u procese dobijanja zelene preko braka. Pokrece se paralelan proces azil proces vam I dalje stoji I tece. To sto ste u azilu nece lose uticati na ishod intervjua za brak recimo sem ako niste u procesu homoseksualnog azila a supruznik je drugog pola. Ukoliko mozete da objasnite zasto je to tako ( primer zelja za zasnivanje porodice ) mozete ocekivati da se intervju nastavi I cak mozda I dobijete zelenu kartu iako ste u azilu se izjasnili kao homoseksualac. Bitno je da su razlozi stvarni.

Za osobe koji hoce da pokrenu / udju u process azila:
Mora postojati problem zbog cega ste napustili zemlju. Ako uradite azil to vasa zemlja nece saznati je azil je tajna izmedju vas I drzave Amerike. Rok je godinu dana od ulaska ali postoje okolnosti pod kojima mozete uci u proces i posle tog roka.

• Ulaskom u process azila necete izgubiti drzavljanstvo svoje drzave sem ako vasa drzava ne dozvoljava dvojno drzavljanstvo ( za Srbiju to nije slucaj i dozvoljeno je dvojno drzavljanstvo)
  Intervju I dobijanje zelene karte ide tek kad prodjete intervju (za 60 dana ako vam zakazu intervju i prodjete ga) ili za 5-6 godine ( 7 god u nekim gradovima) to je od skoro izmena u procesuiranju zahteva, zbog velikog broja slucajeva i nazalost covid-19 i smanjenog osoblja.
• Ako uradite azil I hocete da se ozenite/udate mozete pogotovo ako niste radili gay/homosesualni azil mada postoje sanse I tada ako ste recimo biseksualac. Ako ste radil neki od drugih tzv politickih azila ulazak u paralelan process za zelenu preko braka je lak I odvija se paraleno sa procesom azila.
• Azil je dobra pravna opcija za ljude da dobiju legalnost(papire). Papiri u Americi znace biti dokumentovan imigrant a ne nuzno imati zelenu. (Naravno zloupotrebe mogu biti sankcionisane – morate pisati istinu ne imati nameru sa da dodjete do radne pa pisati bilo sta – Zloupotreba ako bude ustanovljenja u azilu moze da vam zabrani sve statuse do kraja boravka u Americi i kroz druge procese posle)
• Zelena je sledeci visi korak ali biti dokumentovan I imati alien broj znaci imati papire tj. biti legalan u zemlji. Alien broj cete dobiti posle 7-10 dana od dana podnosenja aplikacije. Retki slucajevi su 20-25 dana sto ne znaci da nesto ide lose jednostavno duzi period obrade.
• Uci u proces znaci dobiti dva papira. Prvi mali plavi gde pise da ste “pending” I datum ( ovaj datum je bitan jel se od njega racuna 150 I pravo da se trazi radna dozbola) takodje na njemu najvaznija informacija je alien broj. Mozete ga uslikati ili nauciti. Nece vam verovatno nikad niko traziti sem ako ne upadnete u neki problem pa nije lose da ga znate. Drugi papir, je poziv za otiske I-757 notice of action gde vam kazu da se pojavite na adresi I date otiske. Tamo idete sa pasosem I tim pozivom I ne brinete se nista jel vas nece nista pitati niti znaju sta ste pisali I samo ce vam uzeti otiske. Negde u nekim gradovima I slikati.

Radnu dozvolu cete dobiti sigurno posle 6 ipo do 7 ipo meseci – zagarantovana je od strane drzave. Dobija se na period od 2 godine I obnavlja se svake godine lako slanjem zahteva 60 dana pre isteka vase.

Trazenjem putnicke dozvole advance parole-a ( dokumenta kao viza al nije viza. Neki nasi ljudi zovu Beli Sengen po slicnosti sa putovanjima u evropu nekada pre u proslosti)

Moci cete da putujete ako imate “humanitarian need” kako oni to zovu posle godinu dana od ulaska u proces.

• Savet bolje biti legalan nego nelegalan I ako imate osnovu, probleme da ste proziveli mozete uci u proces. Dobicete instant legalnost koja moze cak I u zelenu da preraste ako odbranite predmet na intervju. Ako slucajno ne odbranite predmet bicete prebaceni na sud koji je jos 2-3 godine od intervju tako da mozete boraviti nekih par godina u americi legalno( I raditi) dok ne dokazete da ste stvarno ugrozeni u mestu, zemlji iz koje dolazite.(Ponavljamo ovo nesme da se zloupotrebljava i zalju ‘fraudulant’ – krivotvoreni azili ) Cak I ako sud ne prodjete ima visi sud, i mozete da trazite withholding of removal I da ostanete u americi do kraja zivota al bez zelene ( ako za sve ovo ima osnova naravno, zasticeni ste u tom slucaju od deportacije )
  Intervju je poput intervju za vizu, jedan na jedan. Kulturni su I pretpostavlja se da je istina sta se napisali. Ukoliko je neko prema vama grup, glasan recimo mozete da pozovete supervizora I trazite da promene osobu sto vas ispituje. Takodje da znate ukoliko stvarno neko bude grub postoji ustanova generalna Kancelarija u Washigtonu kojoj odmah posle mozete poslati mail dopis I objasniti sto prema vama nisu dobro postupali I bice temeljna istraga sprovedena.

Gio Alien Inc. has been dealing with asylum issues for years. We have become the leader in the USA in the number of asylum applicants for people from the Balkan region (Serbia, Montenegro, Bosnia and Herzegovina, North Macedonia, Kosovo).

(In 2015, we managed to solve the problem of DMV not issuing temporary licenses to people with alien plates only – we succeeded in Florida and many are now coming to Florida to get driver’s licenses because Florida allowed it since our letter in 2015. Living legally in the USA means having an active Alien number. An Alien number is a citizen’s identification number like your home-country national-birth-registry-number, which the state assigns.

In America, there are only three legal statuses: VISITOR, ALIEN and CITIZEN.

VISITORS are all people on visas, athletes, students, and even investors with a lot of money who have come to the country. When you enter the documentation process, you become ALIEN (where ALIENs are all documented people registered with the state. Aliens are people who do not have a green card and those who do, there are differences explained later in the text alien-nonresidents and alien-residents) and then there is status being the CITIZEN – as the final status of a US citizen.

So your goal is to get an active Alien number, start a immigration process, which will mean that you have documented yourself with the state that you are legally in the USA. Social or SSN is a tax number, and does not give you legality but only serves as identification for employment and for taxation of people living in America. So people who have an SSN but do not have an Alien number are not yet documented.

We have just added the section “Interview and Court” due to the frequency of questions on this topic at the moment and details such as how to prepare for an interview, do you need a lawyer and why you might not need one right away but only at the Court. And the most important thing is how long the court lasts and how dangerous it is, in fact how not dangerous it is and the normal procedure until receiving the papers. We have also started cooperation with a law firm that is authorized to represent you in court, so we can provide some services for clients who have a solid asylum and have been transferred to court, for example, we can ‘speed up’ the court by skipping the master hearing (meeting with the judge) and requesting an immediate Individual Hearing (where your asylum is actually read) – and thus you find yourself in a position to get a green card (permanent status) after just that one hearing (one Individual Hearing). * * ATTENTION: An increasing number of immigrants confuse legality with obtaining a driver’s or identity card (ID) in the USA. You are not legal if you do not have an active Alien number, so getting a license in Seattle, WA (for instance) where many of our people go under the ‘instructions’ of friends is wrong and misleading and can cause you problems later, and now I will explain how. If you get an ID or driver’s license and you do not live there and one of the neighbors reports it or the postman who knows the tenants has been working for years. It may happen that they enter a ‘fraudulent address’ into your computer – which can follow you throughout your life in the USA, whether you are applying for asylum or getting married later – when immigration gives the green light for a green card, the FBI, to whom the immigration check is forwarded, can stop and delay the delivery of the card without anyone knowing why. Not you or your lawyer, for example. And one of the reasons could be a forged address. So be careful. Having an ID or driver’s license without an Alien number is not legal. Immigration would cut it in two with scissors at the control and might even detain you. It is true that this is proof to the police that you are allowed to drive, but I am explaining to you that it is only an ‘appearance of legality’ that you know that by taking out such a document you are not legal. Furthermore, if you have taken out such a document in the past and now get a work permit – immediately change everything to the real address where you live, because we just had a case where the court, after an upcoming interview, sent a foreigner a summons to Seattle, WA (if the Court sees that the immigrant has an active ID from Seattle) even though the party lives in Chicago, IL, the party missed the court and found themselves automatically in a declared deportation. Be careful, one mistake like using an old ID or Driver’s License can cause you problems.

For those who are already in the process:

The asylum process lasts as you know either 120 days if you immediately get notice to appear for a green card for an interview, or 9 years (the waiting time for an interview if they don’t get you out of the new decision immediately in 4 months). So it’s a matter of luck, and a larger number of applicants go on a waiting list for 9 years than have the opportunity to immediately get a green card in 4 months. Unfortunately, that’s how it is. But again, it also benefits many people because you become legal, and you should live legally in the USA and not hide when traveling between states within America, or you are not allowed to drive a truck past the borders of Canada or Mexico where there are checkpoints (control of the legality of people passing through)

If you entered the process, you have an “alien number” which is the most important residence number in the USA, it is obtained by getting married or applying for asylum. This already means in a way that you have papers (currently you are an alien non-resident and by getting a green card you later become an alien-resident). The key word is that you are already an “Alien” and when the green card comes it is just a higher level of papers that you already have and the path to the goal which is getting American citizenship. With an alien number you have almost the same rights (working for example) as if you had a green card except that your travel outside America is a little more limited (you have to request an advance parole permit every time you want to go/travel)

• There is no way to check how far your case has come – also entering your receipt number will not give you an answer, it may even happen that the system does not recognize it, which does not mean that you are not in the process but simply that the USCIS service is not functioning.

• You can apply for a travel document while you wait and it can be approved approximately once a year for a period of 4-8 weeks, with rare exceptions, longer. The information that it is not safe to travel with a travel document (advance parole) abroad is not true. It is true that it says that entry is not guaranteed, but this applies to people who in the meantime accidentally or intentionally cause someone to commit a crime and, for example, are on a wanted list, in which case the US state reserves the right to deny such cases, i.e., the person has the right not to enter the country. For everyone else, entry is safe. You have to wait up to an hour in a special room (secondary inspection) to check whether you are really the person who has an advance parole. You can do the travel document yourself because everything is explained on the website. (more details under ‘travel document’). The state charges $575,000 for processing the travel application.

• You apply for a work permit 151 days after submission or renew it if it expires (second work permit). The first is free while the second is paid to the state in the amount of $410. In both cases, you can find more information on this site under the “work permit” section.

• Changing your address, if you move, is easy to do and takes 2 minutes. Do it yourself online if you have USCIS account or by typing: ar-11 form uscis on Google. Download form (2 pages) Fill in everything carefully. You have address on page 2 where to file ar-11 for address change.

Getting an ID or Driving license – NOW NEW REAL ID – they are asking work permit, and proof of alien-status such as proof of pending asylum process (best paper is biometrics notice i589, with red-stamp You got after having fingerprints taken at local support center.

• Frequently asked question about marriage: if you get married and are in asylum and you want to enter the process of obtaining a green card through marriage with your spouse. A parallel process is initiated, your asylum process will still stand and continue. The fact that you are in asylum will not have a negative impact on the outcome of the marriage interview, for example, unless you are in the process of homosexual asylum and your spouse is of the opposite sex. If you can explain why this is so (for example, the desire to start a family), you can expect the interview to continue and maybe even get a green card even though you declared yourself homosexual in asylum. It is important that the reasons are real and truth is always said.

For people who want to initiate/enter the asylum process:

There must be a problem why you left the country. If you do asylum, your country will not find out, asylum is a secret between you and the United States. The deadline is one year from entry, but there are circumstances under which you can enter the process even after that deadline.

By entering the asylum process, you will not lose the citizenship of your country unless your country does not allow dual citizenship (this is not the case for Serbia and dual citizenship is allowed)

The interview and obtaining a green card only happens when you pass the interview (in 90 days if they schedule an interview for you and you pass it) or in 8-9 years (10 years in some cities) this is due to recent changes in the processing of requests, due to the large number of cases and unfortunately covid-19 and reduced staff.

If you do asylum and want to get married, you can, especially if you did not do gay/homosexual asylum, although there are chances even then if you are, for example, bisexual. If you have worked in one of the other so-called political asylums, entering the parallel process for green card through marriage is easy and takes place in parallel with the asylum process.

Asylum is a good legal option for people to obtain legality (papers). Papers in America mean being a documented immigrant and not necessarily having a green card. (Of course, abuses can be sanctioned – you have to write the truth, not have the intention of getting a job and writing anything – Abuse if established in asylum can ban you from all statuses for the rest of your stay in America and through other processes after)

Green card is the next higher step, but being documented and having an alien number means having papers, i.e. being legal in the country. You will receive the alien number after 20-25 days from the day you submit the application. Rare cases are 35 days, which does not mean that something is going wrong, simply a longer processing period.

Entering the process means getting 3 papers. The first two papers are the same (similar) where it says you are “pending” and the date (this date is important because it counts towards 150 and the right to claim work-related benefits) also the most important information on it is your alien number. You can take a picture of it and have it in your phone for ICE police if you ever get stopped.

No one will probably ever ask you for it unless you get into some kind of problem, so it’s not bad to know it. The second paper is the I-757 notice of action where they tell you to appear at the address and give your fingerprints. You go there with your passport and that notice and don’t worry about anything because they won’t ask you anything or know what you wrote and they’ll just take your prints. Somewhere in some cities and take a picture.

You will definitely get a work permit after 6 and a half to 7 and a half months – it is guaranteed by the state. It is obtained for a period of 5 years now (which is good) and is easily renewed every 5 years by sending a request 180 days (6 months) before yours expires.

By requesting a travel permit advance parole (a document like a visa but not a visa. Some of our people call it White Schengen because of the similarity with travel to Europe sometime in the past)

You will be able to travel if you have a “humanitarian need” as they call it after a year of entering the process.

Advice: It’s better to be legal than illegal. And if you have a basis, problems that you have experienced, you can enter the process. You will get instant legality which can even grow into green if you defend the case at the interview. If you don’t defend your case, you will be transferred to court, which is another 2-3 years after the interview, so you can stay in America legally (and work) for a few years until you prove that you are really endangered in the place, country you come from. (We repeat, this must not be abused and called ‘fraudulent’ – fake asylum) Even if you don’t pass the court, there is a higher court, and you can request withholding of removal and stay in America for the rest of your life, but without a green card (if there is a basis for all this, of course, you are protected from deportation in that case) The interview is like a visa interview, one on one. They are cultural and it is assumed that what is written is true. If someone is rude to you, loud, for example, you can call the supervisor and ask them to change the person who is questioning you. Also, if someone is really rude, there is an institution called the General Office in Washington, where you can immediately send an email and explain why you were not treated well and a thorough investigation will be conducted.
